राष्ट्रीय हरित अधिकरण क्या है? 


नेशनल ग्रीन ट्रिब्यूनल,[NGT] अधिनियम के अनुसार, 2010 में स्थापित, एक विशेष न्यायिक निकाय है जो देश में पर्यावरणीय मामलों को adjudicating करने के उद्देश्य से पूरी तरह विशेषज्ञता से लैस है।

ट्रिब्यूनल को पर्यावरण पर राष्ट्रीय कानूनों को विकसित करने और उन्हें प्रभावी ढंग से लागू करने के लिए सुप्रीम कोर्ट, लॉ कमीशन और भारत के अंतर्राष्ट्रीय कानून दायित्वों की सिफारिशों के अनुसार सेटअप किया गया था।


ट्रिब्यूनल को पर्यावरण संरक्षण, जंगलों और अन्य प्राकृतिक संसाधनों के संरक्षण और पर्यावरण से संबंधित किसी भी कानूनी अधिकार के प्रवर्तन से संबंधित मामलों में प्रभावी और त्वरित उपाय प्रदान करने का काम सौंपा गया है। 

ट्रिब्यूनल के आदेश बाध्यकारी हैं और इसमें प्रभावित व्यक्तियों को मुआवजे के रूप में राहत देने और नुकसान पहुंचाने की शक्ति है।


प्रावधान एवं संरचना

राष्ट्रीय हरित अधिकरण अधिनियम 2010 के तहत 

गठन   -18 अक्टूबर, 2010

सांविधिक और अर्ध न्यायिक निकाय हैं।

राष्ट्रीय हरित अधिकरण की संरचना-

राष्ट्रीय हरित प्राधिकरण [नेशनल ग्रीन ट्रिब्यूनल] के वर्तमान अध्यक्ष-

 जस्टिस आदर्श कुमार गोयल है।

इससे पूर्व जस्टिस स्वतंत्र कुमार एवं जस्टिस लोकेश्वर सिंह  भी राष्ट्रीय हरित अधिकरण के अध्यक्ष रह चुके हैं।


इसमें अधिकतम 20 पूर्णकालिक सदस्य (नियुक्ति केंद्र सरकार द्वारा )होंगे जिसमें 10 सदस्य न्यायिक क्षेत्र से और 10 सदस्य पर्यावरण के विभिन्न क्षेत्रों के विशेषज्ञ होंगे।

ट्रिब्यूनल की पांच क्षेत्रों में उपस्थिति है- उत्तर, मध्य, पूर्व, दक्षिण और पश्चिम। प्रिंसिपल बेंच नॉर्थ ज़ोन में स्थित है, जिसका मुख्यालय दिल्ली में है।


सेंट्रल ज़ोन बेंच भोपाल में, कोलकाता में ईस्ट ज़ोन, चेन्नई में साउथ ज़ोन और पुणे में वेस्ट ज़ोन में स्थित है।

अधिकरण की शक्तियां - 


सिविल प्रक्रिया संहिता 1908 के तहत अधिकरण को सिविल कोर्ट का दर्जा दिया गया है इसके तहत अधिकरण की शक्तियां इस प्रकार है

1. किसी व्यक्ति के खिलाफ समन जारी करना उसकी उपस्थिति बाध्यता मुल्क बनाना और शपथ पत्र पर उसका परीक्षण करना;

2. दस्तावेजों की खोज करना;

3. हलफनामे पर साक्ष्य प्राप्त करना;

4. अपने निर्णय की समीक्षा करना;

5. गवाहों एवं दस्तावेजों का परीक्षण करना आदि

ट्रिब्यूनल को कौन मामले प्रस्तुत कर सकता है और किस प्रकार के मामलों की सुनवाई की जाती है?


राष्ट्रीय हरित अधिकरण अधिनियम, 2010 की अनुसूची I में उल्लिखित विधानों में पर्यावरणीय क्षति से संबंधित राहत और क्षतिपूर्ति के लिए कोई भी व्यक्ति ट्रिब्यूनल का दरवाजा खटखटा सकता है।

अनुसूची I में विधियां हैं:

जल (प्रदूषण की रोकथाम और नियंत्रण) अधिनियम, 1974;

द वाटर (रोकथाम और प्रदूषण का नियंत्रण) उपकर अधिनियम, 1977;

वन (संरक्षण) अधिनियम, 1980;

वायु (रोकथाम और प्रदूषण का नियंत्रण) अधिनियम, 1981;

पर्यावरण (संरक्षण) अधिनियम, 1986;

सार्वजनिक देयता बीमा अधिनियम, 1991;

जैविक विविधता अधिनियम, 2002।

ट्रिब्यूनल के पास सभी नागरिक मामलों पर अधिकार क्षेत्र है,

 इसके अतिरिक्त, उपरोक्त उल्लिखित विधानों के तहत किसी भी अपीलीय प्राधिकारी के आदेश / निर्देश से व्यथित व्यक्ति भी राष्ट्रीय हरित अधिकरण के समक्ष उन्हें चुनौती दे सकता है।


राष्ट्रीय हरित अधिकरण से संबंधित परीक्षा उपयोगी अन्य महत्वपूर्ण तथ्य

 क्या  ट्रिब्यूनल से संपर्क करने के लिए एक वकील को संलग्न करने की आवश्यकता है?

नहीं,  वकील  की आवश्यकता नहीं है। पीड़ित पक्ष आवश्यक प्रारूप में एक आवेदन जमा करके  ट्रिब्यूनल के पास जा सकते हैं।

क्या कोर्ट के फैसले बाध्यकारी हैं?

हां, ट्रिब्यूनल के फैसले बाध्यकारी हैं। ट्रिब्यूनल के आदेश लागू करने योग्य हैं क्योंकि निहित शक्तियां सिविल प्रक्रिया संहिता, 1908 के तहत एक सिविल कोर्ट में हैं।

ट्रिब्यूनल के फैसले अंतिम हैं?

ट्रिब्यूनल के पास अपने स्वयं के निर्णयों की समीक्षा करने की शक्तियां हैं। यदि यह विफल रहता है, तो नब्बे दिनों के भीतर निर्णय को उच्चतम न्यायालय के समक्ष चुनौती दी जा सकती है।

न्यायिक और विशेषज्ञ सदस्यों की पूरी ताकत के अभाव में ट्रिब्यूनल कैसे कार्य कर रहा है?

चेन्नई, पुणे, भोपाल और कोलकाता में स्थित ट्रिब्यूनल की क्षेत्रीय बेंचों में न्यायिक और विशेषज्ञ सदस्यों की पूरी ताकत के अभाव में, नई दिल्ली में प्रिंसिपल बेंच मुकदमों की जरूरतों को पूरा करने के लिए वीडियो कॉन्फ्रेंसिंग द्वारा दूर से अन्य न्यायालयों के आवेदनों की सुनवाई कर रही है। 

मैं न्यायालय की सुनवाई में कैसे शामिल हो सकता हूं?

ट्रिब्यूनल एक खुली अदालत है और इसकी कार्यवाही में व्यक्तिगत रूप से भाग लिया जा सकता है।

What is National Green Tribunal?

The National Green Tribunal, established in 2010 according to the [NGT] Act, is a specialized judicial body fully equipped for the purpose of adjudicating environmental matters in the country.

The tribunal was set up in accordance with the recommendations of the Supreme Court, the Law Commission and India's international law obligations to develop and effectively enforce national laws on the environment.


The tribunal is tasked with providing effective and expeditious measures in matters relating to environmental protection, protection of forests and other natural resources and enforcement of any legal rights related to the environment.


The tribunal's orders are binding and have the power to relieve and harm the affected persons as compensation.


Provision and structure

Structure of National Green Tribunal-

The current chairman of the National Green Authority [National Green Tribunal] - Justice Adarsh ​​Kumar Goel.


Earlier, Justice Swatanter Kumar and Justice Lokeshwar Singh had also been the president of the National Green Tribunal.

It will have a maximum of 20 full-time members (appointed by the central government) with 10 members from the judicial sector and 10 members from various fields of environmental experts.

The tribunal has presence in five areas - North, Central, East, South and West. The principal bench is located in the North Zone, headquartered in Delhi.

The Central Zone Bench is located in Bhopal, East Zone in Kolkata, South Zone in Chennai and West Zone in Pune.


Powers of NGT-


Under the Civil Procedure Code 1908, the Tribunal has been given the status of Civil Court, under this the powers of the Tribunal are as follows

1. Issuing summons against a person, making his presence obligatory and testing him on affidavit;

2. Searching for documents;

3. Obtaining evidence on affidavit;

4. Reviewing your decision;

5. Testing of witnesses and documents etc.

Who can present cases to the Tribunal and what types of cases are heard?

Any person can approach the tribunal for relief and compensation related to environmental damage in the statutes mentioned in Schedule I of the National Green Tribunal Act, 2010.

The methods in Schedule I are:

The Water (Prevention and Control of Pollution) Act, 1974;

The Water (Prevention and Control of Pollution) Cess Act, 1977;

Forest (Protection) Act, 1980;

The Air (Prevention and Control of Pollution) Act, 1981;

Environment (Protection) Act, 1986;

Public Liability Insurance Act, 1991;

The Biological Diversity Act, 2002.

The Tribunal has jurisdiction over all civil matters,

 In addition, under the above mentioned statutes, any appellate authority's order / directive can also challenge the aggrieved person before the National Green Tribunal.

 Does an attorney need to be attached to contact the tribunal?

No, lawyer is not required. The aggrieved parties can approach the tribunal by submitting an application in the required format.


Are court decisions binding?


Yes, tribunal decisions are binding. The tribunal's orders are enforceable as the vested powers are in a civil court under the Code of Civil Procedure, 1908.


Are the decisions of the tribunal final?

The tribunal has powers to review its own decisions. If it fails, the decision can be challenged before the Supreme Court within ninety days.
