The Election Commission is a permanent and independent body, the provision of which is found in Articles 324 to 329 in Part 15 of the Constitution of India.

It was formed by the Constitution of India with the objective of conducting free and fair elections in the country.

According to Article 324 of the Constitution, the Election Commission has the responsibility of directing and controlling the conduct of elections for the posts of Parliament, State Legislature, President, Vice President.

Election Commission of India -structure /composition


Election Commission of India Structure: - Article 324 of the Constitution provides the following provisions regarding Election Commission


1. The Election Commission consists of the Chief Election Commissioner and other Commissioners.

2. The Chief Election Commissioner and other Election Commissioners should be appointed by the President.

3. The President may, on the advice of the Election Commission, appoint regional commissioners as he thinks necessary to assist the Election Commission.

4. The terms and conditions of service of the Election Commissioner and the Regional Commissioners will be determined by the President.


           From 1950 to 15 October 1990, the Election Commission functioned as a member body with only the Chief Electoral Officer.


After reducing the minimum age of voting from 21 to 18 years, on 16 October 1990, the President appointed two other Election Commissioners to reduce the workload of the Commission, after which the Commission started functioning as a multi-member body in which 3 Election Commissioner.


             However, in 1990, the post of two Election Commissioners was abolished and the position was once before,

        

             But once again two Election Commissioners were appointed in October 1993, since then it has been working as a Commission and member institution with three Election Commissioners.


             The Chief Election Commissioner and other Election Commissioners have the same powers and their salary allowances and other benefits are also the same as judges of the Supreme Court.

Power and functions of Election Commission: - In the context of the election of the posts of President and Vice President of the Legislature of the State of Parliament, the powers and functions of the Election Commission can be divided into three categories-

1. Administrative

2. Advisor

3. Quasi-judicial


1. To determine the territory of the constituencies of all India on the basis of the Delimitation Commission Act of Parliament.

2. Preparation of Electoral Rolls from time to time and register all eligible voters.

3. To determine the date and time of election and to examine the nomination papers.

4. To give recognition to political parties and allot election symbols to them.

5. To act like a court for resolving the dispute in the matter of giving recognition to political parties and giving election marks.

6. Appointment of officers for investigation of disputes related to electoral system.

7. To create a code of conduct for the candidates of the parties at the time of election.

8. Preparation of radio and TV schedule for publicity of policies of political parties at the time of election.

9. To advise the President on matters relating to dependence of Members of Parliament.

10. To advise the Governor on matters relating to dependence of members of the Legislative Council.
